THOUSANDS of title deeds waiting to be issued to foreign property owners in Didim have been suspended amid a high court challenge, Voices can reveal.

The suspension of Tapus, which comes into force from tomorrow (Wednesday April 16) was instigated by the Land Registry in a letter to all Title Deeds offices throughout Turkey due to a lawsuit launched in the Constitutional Court in Ankara.

Panic set in among some estate agents who rushed to the Tapu office in Didim on Tuesday and besieged the workers, and new manager Hüseyin Akdi, in a bid to get hands on Tapus for foreign investors before the office closed at 5pm.

The lawsuit, filed by two Turkish residents, challenged the ease of which foreign companies investing in Turkey could freely acquire real estate or land under the Foreign Direct Investment Law.

The Constitution Court ruling – effectively overturning this part of the law – will have to go to Parliament which will now have to revise it to allow foreign investment to continue.

However, to enable this, the issuing of Tapus has had to be suspended pending Parliament’s final outcome. Once this matter is resolved, Tapus will be issued as normal. It does not mean that new applications for existing title deeds will have to be re-submitted.

Following the Constitutional Court’s ruling – and waiting on Parliament’s actions – the Land Registry issued a letter to all Title Deeds’ mangers calling for the suspension of all Tapus of property and land.

The knock-on effect of this decision means that thousands of property investors and owners already waiting for months and, in some cases, years for their Tapus, will now be left waiting even longer.

The ruling means British property investors can still buy property and land here, but it means estate agents will not be able to apply for their title deeds until Parliament’s decision on the Constitutional Court ruling.

Hello Lesley & Colin this happened to us when we bought our property, the government suspended the issue of tapu’s, we had to wait about 9 month.

Hello all,

We heard about this last Tuesday, however as we did not know exactly what was going on and what the following steps were going to be, we did not post anything yet.

It seems indeed similar to what happened in 2005, but we are not sure yet.
As soon as we know something concrete we'll post it for you all.

So, does this include the tapus that you said were ready for the list of Mayfair residents that you posted back in February, or have they been collected already.

Hello Everybody,

Again this happened due to mass land purchases by foreign companies. Until new law is prepared, there will be a halt on sales of real estate to foreigners. This is something temporary, unfortunately I dont know how long  it will  take. My guess would be between 2 to 8 months. Most of the residents clearance are ready however because of back log at tapu office they have not been transfered yet. This wont effect anybody from using their apartments though when it is finished, so no worries there. I think our old experienced residents will give more insights to you on how it affected them.

Hello all ... Just to let you know and give you a little reassurance that when this happened last time we used the apartment, we just had to wait for the tapu.
Here is a site some of you may have not seen with lots of information on it; they will update the tapu situation on here from time to time.

Hello everyone,

Theres some interesting posts on the TLF turkishlivingforum with some updated news,  most  optimistic  and a few pessimists
Im sure everything will be ok,  theres  big money  been invested in turkey in the property market  which will have a further negative effect if this goes on for too long, Pressure will be put on them by the large developers, companies etc to sort it out soon

Janice,

as described above there is a full stop on tapu's to foreigners all over Turkey until further notice;
No applications
No processing
No issuing

If your property is finished, but your tapu is not transferred to you yet, you can use your properties.

hi so
i did understand what was written about there being a hold on the issuing of TAPU's but was merely enquiring whether perhaps mine was ready before this came into force.

as my contract allows me to keep 10% of the purchase price back until the issuing of the TAPU i won't be able to use the property until then!

Hello Janice,

It might take a while before issuing the title deeds to owners however we give the option to use the property if the payment completed. We will issue as soon as when deeds are allowed to foreigners. To make process faster we are going to ask POA to purchase the property to their name. Lately title deed registery office was delaying issuing of title deeds to longer periods so POA would help us to get things faster. Sorayma will be in contact with everyone soon regarding this.
