Can
I buy a house or land in Turkey?
Yes. In Turkey
foreigners can own land and houses. So you don’t have to worry
about dubious time share constructions or multiple owners.
The moment you’ve received the proof of property (Tapu) and
signed it, you’re the official owner of the property.
UPDATE JULY 2005
We receive a lot of questions regarding the news that 'foreigners
are no longer allowed to purchase property in Turkey'. Underneath
a comprehensive breakdown on what is going on at the moment.
Earlier this year the act that gave permission to foreigners
to purchase property and land in Turkey was overturned by
the Supreme Court as it was not specific enough. Resulting
in putting back the arrangements that existed before the act
came into force.
In short the former arrangements beheld the following:
* Foreigners can purchase property/land
in the municipality area; however this cannot be larger than
10.000 m2
* Foreigners cannot purchase property/land outside the municipality
areas.
* Foreigners wanting to purchase property/land larger than
10.000 m2 need to get permission from the Counsel of Ministry.
* Foreigners who own property/land through testamentary disposition
larger than 10.000 m2 will need the permission of the Council
of Minister to keep them. If they can not obtain this permission,
the property/land will be sold off.
* Foreigners who own property/land through testamentary disposition,
smaller than 10.000 m2 and reside in a country with which
there is no reciprocity agreement about property purchase,
between Turkey and that country, will have to sell that property.
The new adjusted law should make the whole tapu process a
lot easier for buyers, instead of the 3-5 months it takes
now; it was supposed to be a lot shorter. However, any final
decision on the adjustments on the overturned act has been
postponed until after the government’s summer recess. Until
there is a final decision on that act no tapu's are being
processed nation wide.
In practice this means that the deeds to the property
you bought or are buying will be delayed. It does not mean
that foreigners can no longer buy or own property in Turkey.

What is the
process of buying a house?
Once you and Sun
Escape have agreed on a sale, an application has to be made
to the local Land Registry Office (Tapu office). The Land
Registry Office performs a search for any restrictions through
correspondence with the military authorities in the area.
The moment the search is completed, the Land Registry Office
transfers the title and issues the new deed.

Can you build me
a house in Turkey?
Yes we can! When
you tell us what you are thinking about, we will find you
the exact spot you can build on. When you have chosen your
definate piece of land, together with you, we will design
your house and have it build for you. We will update you frequently
on the construction progress and will not decide anything
without your approval. All to ensure you will end up with
your Turkish dream home.

Is your real
estate agency acknowledged by any organization?
Turkey does not
have an umbrella organization like NAEA (National Association
of Estate Agents) to uphold standards. So basically anybody
can open up a real estate agency. However, agents in Turkey
must be registered at the chamber of commerce and have a licence.
So a good real estate agent is one that has at least both!
If you are not sure about an agent, feel free to ask about
the licence or even have it shown. Furthermore the agent should
be able to answer all your questions to your full satisfaction
and interpret your wishes by finding you just the right property.

How do I know I can
trust you?
We hope we can

What is this
0% commission?
Commission is paid
to the agent for their services. It includes the whole process
of showing you around the area and taking you to different
properties and taking care of you and your family during that(/those)
day(s), all the way up to the signing of the contract between
you and the house owner. However if you buy a home build by
Sun Escape Real Estate, we will not charge you that commission.
That's a nice little extra to keep in you pocket and celebrate
from with your family!

Can I see the
property before I decide to buy it?
Yes! We highly
recommend it. A viewing trip is very important so you have
a more lively idea about the property and to see if it is
really suited for you.

What exactly
is a viewing trip?
A viewing trip
means nothing more than comming to Turkey and take a look
at the property you've selected from our website or from our
e-mail/phone conversations. We will arrange a pick up from
the airport if wanted an can arrange accomodation if you'd
like. When you've already taken care of transfers/accomodation
yourself, just let us know where you are staying so we can
pick you up at a pre-arranged date and take you out to view
the homes you've selected and let you get familiar with the
area.
Sun Escape Real Estate offers a max. GBP 300.- refund on flight/transfer/accomodation
for viewing trips in case of purchase.
As viewing can take a few hours in the blistering sun, dress
properly for viewings; meaning wear comfortable shoes, bring
a little water bottle and wear sun protection. If you want

Are there flights
all year round?
Throughout the
summer season there are regular direct flights to Izmir International
Airport and Bodrum International Airport. Transfer from both
airports to Kusadasi or Didim is approximately 1 – 1,5 hours.
In winter (spring and autumn) you would have to fligh to Istanbul
International Airport and get a connected flight from there.

Do I need a visa
to visit Turkey?
Yes. To enter Turkey
you need a visa. You can purchase one when you go through
customs.

I stay in Turkey?
On a tourist visa
you are allowed to stay in Turkey for three months.

Can I become a
resident?
Yes. The process
of becoming a resident is not extremely difficult. Required
items for a residency permit are your passport, your bank

Will I
have to provide any documents when I buy property?
Yes you do. A copy
will be made from your passport and than be translated into
Turkish. The buyer also needs to provide four recent passport
photographs.

What about legal issues/lawyers?
We work closely
with Turkish lawyers regarding property transactions. People
wanting to buy property in Turkey can be apprehensive about
their choice of lawyer since they are not familiar with either
the law firms or, in most cases, the civil law system. Sun
Escape Real Estate can put your mind at ease regarding this,
by recommending reliable lawyers who will provide a professional
and efficient service. Also if you wish, we can act on your
behalf, through a Power of Attorney or a written authority,
to actually complete the purchase of property on your behalf.

There are, like
in your own country, taxes that need to be paid. When you've
decided on the property suited for you, we will provide you
with a full overview of taxes that you will encounter.

What are extra
costs I should keep in mind?
Depending on the
property there could be maintenance fees or other fees. But
on the day of purchase you will have pay a deposit on the
property (negotiated between seller and buyer) and a fee for
the lawyer and translator (approx 300 GBP). Sun Escape will
provide you a detailed overview of (extra) costs when you've
made your definite choice in property.

How do I pay
for the property?
In the rule you
would do a down payment of 10-20 % of the total purchase price.
Following the down payment the payment plans differ by every
house owner. Sun Escape will go over every financial detail
with you so everything will be clear and there will be no
surprises

Are
there extra services like maintenance during the time I’m
not in living there?
In case the property
you bought is owned by Sun Escape Real Estate, we will take
care of maintainance issues to the full extend and we mediate
between you and the supplier for other services. To help out
everybody that buys from us, we (together
with professional partners) have come up with service
packages against a competetive rate including services like
maintenance, cleaning, renovation, gardening etc.

Can I rent out my
house during the time I’m not living in Turkey?
Yes you can. We
can mediate in renting out your property. Help you set up
rental agreements, keeping an availability calendar and promote
your property. However Sun Escape cannot be held responsible
for any damages that may occur while your property is rented
out nor can we be held responsible for not having your property
fully booked all year through.

Unfortunately this
could happen. At Sun Escape we will go the extra mile to make
sure you are happy with your new purchased home. If for whatever
reason you are not happy, please let us know immediately so

Yes we do. On all
our property we give a ten year building guarantee.

What about earthquakes?
Turkey has fault
lines in some areas and therefore minor earthquakes do happen.
Buildings that have been constructed during the last four
years are all built to withstand earthquakes. When you buy
property you will be obliged to get earthquake insurance.
